La presente investigación estudia las limitaciones que posee la recién constituida Asamblea Nacional Constituyente (ANC) venezolana de 2017 en materia económica, ya que ningún poder puede ejercerse de manera ilimitada. La metodología seguida está enmarcada en una revisión documental y jurisprudencial de carácter analítico, que ajusta el poder constituyente del Estado. La ANC debe, por un lado, fomentar la irreversibilidad y la progresividad antagónica de los derechos económicos; y por el otro, la promoción de los derechos sociales; en una economía que debe regirse por la neutralidad política en un proceso de adaptación del Estado a las circunstancias sociales existentes, porque el Estado de Derecho obliga a enmarcar cualquier actuación estatal al respeto de los derechos humanos y sus garantías.

The present investigation seeks to study the limitations of the recently formed Venezuelan Constitutional Congress of 2017 (ANC, by its acronym in Spanish) in economic terms, since no power can be exercised in an unlimited manner. The methodology used is framed in a documentary and jurisprudential review of an analytical nature, which adjusts the constituent power of the State. The ANC must promote the antagonic irreversibility and progressivity of Economics Rights on one hand; and the promotion of Social Right on the other hand; in a capitalist economy that must get ruled by a political neutrality in a process of adaptation to the existing social circumstances, because the Rule of Law makes adjust to the State’s proceeding according to the respect of the human rights.
